Mediation

Mediation is an alternative dispute resolution method often used to help couples reach agreements on contentious issues like the ones noted above. A neutral mediator facilitates discussions, helping both parties communicate effectively and negotiate mutually acceptable solutions. Mediation offers a less adversarial and potentially more cost-effective approach than court litigation, providing a private and collaborative environment that can reduce stress and preserve relationships.

During mediation sessions, parties can openly discuss their concerns and preferences, with the mediator guiding the conversation in the spirit of fairness and respect. The mediator does not make decisions but helps identify common ground and possible creative solutions.

This method empowers couples to control the outcomes of their divorce, with the goal of reaching more satisfactory and sustainable agreements.

    Post-Divorce Modifications

Post-divorce modifications address changes in conditions that affect the original divorce settlement. To qualify for a modification, the petitioner must demonstrate a "significant and continuing" change in circumstances. Such changes include job loss, substantial pay cuts, serious health issues, remarriage, relocation, or significant shifts in the children's needs. The change must be substantial and long-lasting, not temporary or minor.

Courts review these requests carefully to maintain fairness and reflect the new realities faced by the ex-spouses. For instance, a significant decrease in income may warrant a reduction in spousal or child support payments.

The objective of post-divorce modifications is to provide stability and justice, accommodating the evolving circumstances of the ex-spouses and their children. Both parties can request modifications, and mediated agreements are often encouraged to avoid prolonged court battles and promote amicable and practical solutions.
